1. ข้อตกลงทั่วไป

แอปพลิเคชัน NewWorld (“แอป”, “บริการ”) ดำเนินการโดย NewWorld Company (“เรา”)

การดาวน์โหลด เข้าถึง หรือใช้งานแอป ถือว่าคุณได้อ่าน เข้าใจ และยอมรับข้อกำหนดฉบับนี้แล้ว หากคุณไม่ยอมรับ กรุณาหยุดใช้งานและถอนการติดตั้งแอป

เราอาจแก้ไขข้อกำหนดฉบับนี้เป็นครั้งคราว หากมีการเปลี่ยนแปลงสาระสำคัญ เราจะแจ้งผ่านแอปหรือหน้าเว็บนี้ล่วงหน้าอย่างน้อย 7 วัน การใช้งานต่อหลังจากนั้นถือว่าคุณยอมรับข้อกำหนดฉบับใหม่

2. รายละเอียดบริการ

NewWorld เป็นแอปเรียนคำศัพท์ภาษาอังกฤษสำหรับผู้ใช้ชาวไทย ให้บริการแบบฟรี โดยมีรายได้จากการแสดงโฆษณา

เราอาจปรับปรุง เปลี่ยนแปลง ระงับ หรือยุติส่วนใดส่วนหนึ่งของบริการได้ตลอดเวลา ทั้งชั่วคราวและถาวร โดยจะพยายามแจ้งให้ทราบล่วงหน้าเมื่อทำได้

3. บัญชีผู้ใช้

3.1 การสมัคร

คุณสามารถใช้งานแอปได้ 3 วิธี:

• สมัครด้วยอีเมลและรหัสผ่าน

• เข้าสู่ระบบด้วยบัญชี Google

• เล่นแบบผู้เยี่ยมชม (Guest) — ไม่ต้องให้ข้อมูลส่วนตัว

3.2 ความรับผิดชอบของคุณ

• ให้ข้อมูลที่ถูกต้องและเป็นปัจจุบัน

• รักษารหัสผ่านของคุณเป็นความลับ

• รับผิดชอบต่อกิจกรรมทั้งหมดที่เกิดขึ้นผ่านบัญชีของคุณ

• แจ้งเราทันทีหากพบว่าบัญชีถูกใช้งานโดยไม่ได้รับอนุญาต

3.3 ข้อควรทราบสำหรับผู้เยี่ยมชม

หากคุณเล่นแบบผู้เยี่ยมชมโดยไม่ผูกบัญชีกับอีเมล ข้อมูลความคืบหน้า เหรียญ และสถานะ VIP จะผูกกับอุปกรณ์เครื่องนั้น หากถอนการติดตั้งแอปหรือเปลี่ยนเครื่อง ข้อมูลอาจสูญหายและกู้คืนไม่ได้

เราแนะนำให้ผูกบัญชีกับอีเมลเพื่อเก็บความคืบหน้าไว้อย่างปลอดภัย

4. การใช้งานที่ยอมรับได้

คุณตกลงว่าจะ ไม่:

• ใช้โปรแกรมโกง เครื่องมืออัตโนมัติ บอท หรือดัดแปลงแอปเพื่อให้ได้เหรียญ เพชร หรือสถานะ VIP โดยไม่ถูกต้อง

• พยายามเข้าถึงระบบ เซิร์ฟเวอร์ หรือฐานข้อมูลของเราโดยไม่ได้รับอนุญาต

• ทำวิศวกรรมย้อนกลับ ถอดรหัส หรือแยกส่วนแอป

• คัดลอก ทำซ้ำ หรือเผยแพร่เนื้อหาในแอปเพื่อการค้า

• ใช้บริการในทางที่ผิดกฎหมายไทยหรือกฎหมายที่บังคับใช้กับคุณ

• ใช้บัญชีหลายบัญชีเพื่อหลบเลี่ยงข้อจำกัดในการรับรางวัลจากโฆษณา

การละเมิดข้อกำหนดนี้อาจส่งผลให้บัญชีถูกระงับหรือยกเลิกถาวร โดยไม่มีการคืนเหรียญ เพชร หรือสถานะ VIP ที่เหลืออยู่

5. สกุลเงินในเกมและไอเทม

5.1 เหรียญ (Coins)

• ได้รับจากการดูโฆษณาแบบรับรางวัล (rewarded ads)

• มีข้อจำกัดจำนวนครั้งต่อวันและระยะเวลาพักระหว่างครั้ง

• ใช้แลกไอเทมในเกมและสิทธิ์ VIP ระยะสั้น

5.2 เพชร (Gems)

• สกุลเงินพิเศษสำหรับแลกสิทธิ์ VIP ระยะยาว

• ปัจจุบันยังไม่เปิดให้ซื้อด้วยเงินจริง หากเปิดในอนาคต จะดำเนินการผ่าน Google Play Billing เท่านั้น และจะมีการแจ้งเงื่อนไขเพิ่มเติมก่อน

5.3 สถานะ VIP

สิทธิประโยชน์อาจรวมถึงการไม่แสดงโฆษณาคั่น การปลดล็อกบทเรียน และฟีเจอร์พิเศษอื่นๆ ตามที่ระบุในแอป ณ เวลานั้น

5.4 ข้อกำหนดร่วม

• เหรียญ เพชร ไอเทม และสถานะ VIP เป็น สิทธิ์การใช้งานภายในแอปเท่านั้น ไม่ใช่ทรัพย์สินของคุณ และไม่มีมูลค่าเป็นเงินจริง

• ไม่สามารถโอน ขาย แลกเปลี่ยน หรือขอคืนเป็นเงินสดได้

• เราอาจปรับเปลี่ยนราคา อัตราการได้รับ ข้อจำกัด หรือสิทธิประโยชน์ได้ตลอดเวลา

• หากคุณลบบัญชีหรือบัญชีถูกระงับ สิ่งเหล่านี้จะหายไปโดยไม่มีการชดเชย

6. โฆษณา

แอปแสดงโฆษณาผ่าน Google AdMob เพื่อให้บริการฟรีต่อไปได้

• โฆษณาแบบรับรางวัล (rewarded) เป็นทางเลือก คุณจะได้เหรียญเมื่อดูจนจบเท่านั้น

• โฆษณาคั่น (interstitial) และแบนเนอร์อาจปรากฏระหว่างใช้งาน

• เราไม่ควบคุมเนื้อหาโฆษณาที่ Google เลือกแสดง หากพบโฆษณาที่ไม่เหมาะสม กรุณาแจ้งเราพร้อมรายละเอียด

• ดูวิธีปิดโฆษณาแบบเฉพาะบุคคลได้ใน นโยบายความเป็นส่วนตัว

การพยายามโกงระบบรางวัลจากโฆษณา (เช่น ใช้เครื่องมือปลอมการดูโฆษณา) ถือเป็นการละเมิดข้อกำหนดร้ายแรง และอาจถูกระงับบัญชีถาวร

7. ทรัพย์สินทางปัญญา

เนื้อหาทั้งหมดในแอป — คำศัพท์ ไฟล์เสียง ภาพประกอบ ตัวละคร การออกแบบ ซอฟต์แวร์ และเครื่องหมายการค้า “NewWorld” — เป็นทรัพย์สินของเราหรือผู้ให้สิทธิ์ของเรา

คุณได้รับสิทธิ์ใช้งานแบบ ส่วนบุคคล ไม่ผูกขาด โอนไม่ได้ และเพิกถอนได้ เพื่อการเรียนรู้ส่วนตัวเท่านั้น

ห้ามคัดลอก ดัดแปลง เผยแพร่ หรือนำไปใช้เพื่อการค้าโดยไม่ได้รับอนุญาตเป็นลายลักษณ์อักษรจากเรา

8. การยุติการใช้บริการ

8.1 โดยคุณ

คุณสามารถหยุดใช้บริการได้ตลอดเวลาโดยถอนการติดตั้งแอป และขอลบบัญชีตามขั้นตอนใน นโยบายความเป็นส่วนตัว

8.2 โดยเรา

เราอาจระงับหรือยกเลิกบัญชีของคุณได้ หากพบว่า:

• ละเมิดข้อกำหนดฉบับนี้

• ใช้โปรแกรมโกงหรือหลบเลี่ยงระบบป้องกัน

• ใช้บริการในทางที่ผิดกฎหมาย

ในกรณีร้ายแรง เราอาจดำเนินการทันทีโดยไม่แจ้งล่วงหน้า

9. ข้อจำกัดความรับผิด

บริการนี้ให้ “ตามสภาพที่เป็นอยู่” (as is) เราไม่รับประกันว่า:

• แอปจะทำงานได้ต่อเนื่องโดยไม่มีข้อผิดพลาดหรือหยุดชะงัก

• เนื้อหาคำศัพท์ คำแปล หรือคำอ่านจะถูกต้องสมบูรณ์ทุกรายการ

• ผลลัพธ์การเรียนรู้จะเป็นไปตามที่คุณคาดหวัง

เราไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายสืบเนื่อง การสูญหายของข้อมูล หรือการสูญเสียโอกาส ที่เกิดจากการใช้หรือไม่สามารถใช้บริการได้

ข้อจำกัดนี้ใช้เท่าที่กฎหมายไทยอนุญาต และไม่จำกัดความรับผิดในกรณีที่กฎหมายไม่อนุญาตให้จำกัด

10. ความเป็นส่วนตัว

การใช้บริการอยู่ภายใต้ นโยบายความเป็นส่วนตัว ของเราด้วย ซึ่งอธิบายว่าเราเก็บและใช้ข้อมูลของคุณอย่างไร

11. เด็กและเยาวชน

แอปนี้เหมาะสำหรับผู้ใช้ทุกวัย หากคุณอายุต่ำกว่า 20 ปี ควรได้รับความยินยอมจากผู้ปกครองก่อนใช้งาน โดยเฉพาะการสมัครบัญชีด้วยอีเมล

12. บริการของบุคคลที่สาม

แอปใช้บริการของบุคคลที่สาม ได้แก่ Google Firebase และ Google AdMob ซึ่งมีข้อกำหนดและนโยบายของตนเอง เราไม่รับผิดชอบต่อการดำเนินการหรือความขัดข้องของบริการเหล่านั้น

13. กฎหมายที่ใช้บังคับ

ข้อกำหนดฉบับนี้อยู่ภายใต้บังคับของ กฎหมายแห่งราชอาณาจักรไทย

ข้อพิพาทที่เกิดขึ้นจะอยู่ในเขตอำนาจของศาลไทย

14. เบ็ดเตล็ด

• หากข้อกำหนดข้อใดถูกตัดสินว่าใช้บังคับไม่ได้ ข้อกำหนดที่เหลือยังคงมีผลสมบูรณ์

• การที่เราไม่บังคับใช้สิทธิใดในคราวหนึ่ง ไม่ถือเป็นการสละสิทธิ์นั้น

• ข้อกำหนดฉบับนี้ประกอบกับนโยบายความเป็นส่วนตัว ถือเป็นข้อตกลงทั้งหมดระหว่างคุณกับเรา

Terms and Conditions of Service — NewWorld (English)

1. General

NewWorld (the “App”, “Service”) is operated by NewWorld Company (“we”, “us”).

By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please stop using and uninstall the App.

We may update these Terms from time to time. Material changes will be announced in the App or on this page at least 7 days in advance. Continued use after that constitutes acceptance.

2. Description of Service

NewWorld is a free English vocabulary learning app for Thai speakers, supported by advertising revenue.

We may improve, modify, suspend, or discontinue any part of the Service at any time, temporarily or permanently, with advance notice where practical.

3. User Accounts

3.1 Registration options

• Email and password

• Google Sign-In

• Guest mode — no personal information required

3.2 Your responsibilities

• Provide accurate and current information

• Keep your password confidential

• Take responsibility for all activity under your account

• Notify us immediately of any unauthorized use

3.3 Note for Guest users

If you play as a Guest without linking an email, your progress, coins, and VIP status are tied to that device. Uninstalling the App or switching devices may result in permanent data loss.

We recommend linking an email account to keep your progress safe.

4. Acceptable Use

You agree not to:

• Use cheats, bots, automation tools, or modify the App to obtain coins, gems, or VIP status improperly

• Attempt unauthorized access to our systems, servers, or databases

• Reverse engineer, decompile, or disassemble the App

• Copy, reproduce, or distribute App content for commercial purposes

• Use the Service in violation of Thai law or laws applicable to you

• Use multiple accounts to circumvent ad-reward limits

Violations may result in suspension or permanent termination of your account, with no refund of remaining coins, gems, or VIP status.

5. In-Game Currency and Items

5.1 Coins

• Earned by watching rewarded advertisements

• Subject to daily limits and cooldown periods

• Used to redeem in-game items and short-term VIP access

5.2 Gems

• Premium currency for long-term VIP access

• Currently not available for purchase with real money. If introduced in the future, purchases will be processed exclusively through Google Play Billing with additional terms provided beforehand.

5.3 VIP Status

Benefits may include removal of interstitial ads, unlocked lessons, and other features as described in the App at that time.

5.4 Common terms

• Coins, gems, items, and VIP status are licenses to use features within the App only. They are not your property and have no real-world monetary value.

• They cannot be transferred, sold, exchanged, or redeemed for cash.

• We may modify prices, earning rates, limits, or benefits at any time.

• If your account is deleted or suspended, these will be forfeited without compensation.

6. Advertising

The App displays advertisements through Google AdMob to remain free.

• Rewarded ads are optional; coins are granted only upon full completion

• Interstitial and banner ads may appear during use

• We do not control the ad content Google serves. Please report inappropriate ads with details.

• See our Privacy Policy for opting out of personalized ads

Attempting to defraud the ad-reward system (for example, using tools to simulate ad views) is a serious violation and may result in permanent account termination.

7. Intellectual Property

All App content — vocabulary, audio files, illustrations, characters, design, software, and the “NewWorld” trademark — belongs to us or our licensors.

You receive a personal, non-exclusive, non-transferable, revocable license for personal learning use only.

Copying, modifying, distributing, or commercial use without our written permission is prohibited.

8. Termination

8.1 By you

You may stop using the Service at any time by uninstalling the App, and request account deletion following the process in our Privacy Policy.

8.2 By us

We may suspend or terminate your account if you violate these Terms, use cheats or circumvent protections, or use the Service unlawfully. In serious cases, we may act immediately without prior notice.

9. Disclaimer and Limitation of Liability

The Service is provided “as is”. We do not warrant that:

• The App will operate uninterrupted or error-free

• All vocabulary, translations, or pronunciations are complete and accurate

• Learning outcomes will meet your expectations

We are not liable for indirect or consequential damages, data loss, or lost opportunities arising from use of or inability to use the Service.

These limitations apply to the extent permitted by Thai law and do not limit liability where the law does not allow limitation.

10. Privacy

Use of the Service is also governed by our Privacy Policy.

11. Children

This App is suitable for all ages. Users under 20 years old should obtain parental consent before use, particularly when registering with an email address.

Parents may request deletion of their child's account and data at newworldproject88@gmail.com.

12. Third-Party Services

The App uses Google Firebase and Google AdMob, each governed by their own terms. We are not responsible for their operations or outages.

13. Governing Law

These Terms are governed by the laws of the Kingdom of Thailand. Disputes fall under the jurisdiction of Thai courts.

14. Miscellaneous

• If any provision is found unenforceable, the remaining provisions remain in full effect

• Failure to enforce any right on one occasion is not a waiver of that right

• These Terms, together with the Privacy Policy, constitute the entire agreement between you and us
